De Makelaar is responsible for the processing of your personal data and will exercise the utmost care and, of course, comply with the rules arising from the GLA and other laws and regulations.

Personal data that we process, base and purposes

Customers

If you enable us to rent a property, we ask you to provide us with the following personal information:

• your name, address, gender and contact details such as your telephone number and e-mail address;
• the description and characteristics of the home such as area, cadastral data, WOZ value, the asking price or rent, and so on;
• a copy of your passport or identity document, in which we make the BSN number unreadable.

We process this personal data, and other data that you voluntarily provide us with, to assist you in the rental of your home. The basis for this processing is to execute the agreement that you have entered into with us.

We ask you for the copy of your passport or identity card because we are obliged under the Money Laundering and Terrorist Financing (Wwft) Act to identify our customers on the basis of the original proof of identity and to record the details thereof. We make the BSN number unreadable because there is no legal basis for processing it.

If you involve us for the purchase or rental of a property, we request that you provide us with the following personal information:

• your name, address, gender and contact details such as your telephone number and e-mail address;
• the search profile with your living requirements, including the maximum purchase price or rental price you want to pay;
• a copy of your passport or identity card, in which we make the BSN number unreadable;
• if you are interested in a home, we can ask you to provide additional information such as pay slips, bank statements, employer’s declaration or an extract from the population register;
• after you have rented a home: your new address and the transaction details;

We process this data, and other information that you voluntarily provide us, to assist you in finding and buying or renting a home. The basis for this processing is to execute the agreement that you have entered into with us.

We ask you for the copy of your passport or identity card because we are obliged under the Wwft to identify our customers on the basis of the original proof of identity and to record the details thereof. We make the BSN number unreadable because there is no legal basis for processing it.

Payment details

If you provide us with an order, we also process information that is necessary for sending an invoice for the services provided by the Broker and receiving payments (such as your bank account number). The basis for this processing is to execute the agreement that you have entered into with us.

Potential customers

We also process personal data from potential customers. From visitors to our website who fill in the search form provided on it, we record the following data:

• name, address, telephone number and e-mail address;
• the search profile with your housing requirements, including the maximum rent you want to pay;
• the time you filled in the form.

From potential customers who approach us in other ways – such as by e-mail, telephone or by issuing a business card, we process the data they leave with us. This concerns the contact details that you provide to us and the reason why you contact us (for example because you have a question).

We use the contact details you provide to contact you if necessary, for example to send you the results of a search or to answer a question. We process these personal data because this is necessary for the protection of our legitimate interest, namely the importance of being able to carry out our work and obtaining new assignments.

Analysis of website visitors

Finally, we process analytical information about (the computer of) visitors to our website, via cookies that are placed when you visit the website. Through these cookies (a part of) the IP address of the visitor is stored.

How long do we keep your personal data?

Administration

We keep our records, including invoices and other administrative documents on which your personal data are mentioned, for a period of seven years after the end of the financial year in order to comply with the fiscal retention obligation.

Copy of passport

We keep the copy of your passport or identity document for a period of five years in order to comply with the obligation to retain in the Wwft.

Other contact details

We keep other contact details for two years after the last contact, unless you have previously submitted a request to us to delete it.

Analysis of website visitors

The data about website visitors is stored two years after the visit to the website, these are the default settings of Google Analytics.

With whom do we share your data?

We may provide the information you give to us to third parties if this is necessary for the execution of the above described purposes.

For example, we use external parties for:

• taking care of the (financial) administration;

We of course make the necessary arrangements with these parties (processors) to ensure the security of your personal data.

We may also provide your information to third parties if you so request. For example, we can provide your information directly to a civil-law notary if you decide to purchase a home.

We will not pass on your details to third parties unless we are required by law and regulations to provide certain information, for example to the police in the context of a criminal investigation.

How are your data secured?

We have taken appropriate technical and organizational security measures to protect your personal data against loss, misuse and unauthorized access by third parties. Moreover, we also require our ICT provider to take such appropriate technical and organizational security measures.

What are your rights?

You have the following rights:

1. The right to inspect your personal data and to receive a copy thereof.
2. The right to rectification of your personal data if these are not correct or incomplete.
3. The right to object to the processing and / or – in certain cases – the right to limit the processing of your personal data.
